Our practice regularly handles disputes in several areas, including zoning, permitting and land use; construction and design; commercial leasing; contract disputes; and financing and acquisitions.

We represent both for profit entities, such as developers of shopping malls, office towers and mixed-use properties, as well as nonprofit organizations, including one of the world’s preeminent universities. Regardless of who our client may be, we know that its time and resources are best spent in the real estate business. We appreciate that the best resolution of most real estate disputes is the one that is not only favorable but prompt.
Our Cases
We represent our clients in the Land Court, Superior Court, Appeals Court, and Supreme Judicial Court; in the federal courts; and before agencies, arbitrators and mediators. Some of our firm’s many recent engagements include:
- Defeated challenge to developer’s Municipal Harbor Plan Amendment for a $100 million mixed-use waterfront development, and successfully defended the victory before the Court of Appeals.
- Represented architectural firm in litigation involving a $20 million residence; after obtaining anti-SLAPP dismissal of contractor’s cross-claim, negotiated a highly favorable settlement.
- Represented developer at trial against medical facility’s claimed exercise of a purchase option; the medical facility offered a very attractive settlement immediately after cross-examination of its primary witness.
- Defended owner of waterfront estate against a zoning challenge by an abutting property owner.
- Obtained large settlement payment for architectural firm in a dispute involving the design of a 170,000 square foot athletic complex.
- Obtained a successful settlement for a development consultant owed half a million dollars in fees for overseeing the acquisition, design, permitting, financing and leasing of his client’s real estate ventures.
- Represented a large university in several real estate disputes in Cambridge, Massachusetts.
- Represented real estate developers and investors in commercial lease disputes involving office towers, shopping malls and other properties.
- Represented developers and owners in disputes with contractors, subcontractors, vendors and suppliers.
